‘TAKE 5’ DNL #13: DEC ‘18’ & JAN ‘19’; ‘TAKE 5’ FILES PRELIMINARY INJUNCTION IN THE 8TH DISTRICT COURT OF NEVADA AGAINST THE CCSD & THEIR ASSOCIATION WITH SCOTT BAKER/SNVBS. THE 2018 2nd COLLEGE FOOTBALL PILGRIMAGE CREATES MANY BLESSINGS INCLUDING THE VALUE OF GRATITUDE. STOP IN FOR A MOMENT AND/OR PASS IT ON.
EDITOR’S NOTE: This is an edition of the same story that is posted on our Facebook page.
For those of you who are loyal followers of the Nick Feher ‘TAKE 5’ Foundation Facebook Page welcome again inside the Quest For the Truth of My INSANITY. The Quest has now reached its ‘END GAME’. A quick recap is needed for the newbies or others that need a refreshment. Our involvement with Basic Academy/HS in Henderson, NV began when Nick entered the school in the fall of 2003. His brother Michael and sister Megan followed two years later and graduated in the spring of 2009. After Nick’s Physical Passing in November of 2007, Basic High School accepted our offer to award a $500 scholarship to one senior baseball player starting in the spring of 2008. This scholarship was originally set up by the generosity of the Henderson Community and others with cash donations in Nick’s memory. Eventually, this award was rescinded by Scott Baker in late spring of 2015.

It was in the early spring of 2015 that the ‘Destroyer of Dreams’ sent waves into the direction of my Fishbowl that caused my ‘Bowl to Rock’. This rocking shook my INSANITY loose and My Quest began. Most of My Quest is documented on this Facebook page somewhere in the archives starting around the same TIME. What began as an writing expedition with very little paragraphing, appeared to some as ramblings. Once a better format was installed, ramblings turned to prose. This prose at TIMES created reactions from the readers. Except for a few, all reactions were left posted for everyone to read. Eventually, these writings in a different format migrated to our website @ playinyourdreams.com. (

For those of you who have come to read about the Temporary Injunction, please scroll ahead. For you others, place on your IMAGINATION Helmets as the story begins with the 2018, 2nd College Football Pilgrimage (CFP). My 1st CFP was completed in 2017. It was a culmination of many seasons, but my Feet finally either played in, sat in, or both, the 10 largest attendance wise College Football Stadiums in the USA. The CFP starting in the fall of 2015 was to be the first documented on our website @ playinyourdreams.com in the College Football Pilgrimage (PILGRIMAGE) Section on the Homepage. This story is a short story format with almost 9,000 words and images. Chew all at once or visit for multiple servings.
2018, 2nd COLLEGE FOOTBALL PILGRIMAGE (CFP)
All of the yearly official CFPs that began in 2011 have resulted in their own unique Blessings & Gifts. With the 10 largest Stadiums in the books, the 2nd CFP would revolve around the ‘Oldest College Football Stadiums/Field’ that stand in the USA. A quick lesson in the history of ‘USA Football’ is needed. Some form of football had been played primarily on the east coast since the 1820’s/1830’s. History claims that the game started on the college campuses and prep schools. Some called it ‘Mob Ball’. Harvard University delicately named it ‘Bloody Mondays’. In the early days, the final score was a mere formality. The ‘Official Score’ was determined by how many players were injured. Players that had to be carried off the field were worth more.

Rules varied with the location and home field advantage. Usually teams had 50 or more players. Sizes of the fields were randomly marked. The objective was to have the ball cross over your opponent’s goal line to score. Some only permitted kicking the ball. Others included kicking and batting the balls with your hands and arms. A few permitted running with the ball. Players were known to wear sharp instruments on their arms and shoes to inflict as much damage to their opponents as possible. The games were only recreational and played by teams of classmates within the same schools.
During the early 1860’s, the game was eventually banned on the campuses of universities, colleges and prep schools because of the injuries. After a cooling off period for a few years, the Game of Football returned in a style of ‘Kick the Ball’ only. Rules were modified and the number of the players were reduced from a large Mob to a small Mob. In the fall of 1869, Rutgers University played against Princeton University in what is now officially named the 1st College Football Game and the 1st College Soccer Game in the USA. Other universities and colleges on the east coast soon started to play contests against each other. A price for admission started to produce additional revenue for the schools. As the game grew, so did the rules. After Harvard U played McGill U from Canada during the 1874 season, Harvard adopted the ‘Rugby Style’ introduced by McGill.

Remember, in those days, news traveled by mail or in the newspapers. The scheduling of contests sometimes took months and with different rules still being used depending on the location, many issues remained unresolved. It was then that Yale and Harvard took the lead as ‘Birthing Partners’ of American Football. Walter Camp a graduate of Yale is referred to as the ‘Father of American Football’. Princeton, Penn University and others also assisted the ‘Birthing Partners’ to create the ‘Modern Day American Football’. As the game grew in popularity on the campuses of universities, colleges, prep schools, and high schools in the USA, violence continued to mar once again the game.
President Teddy Roosevelt called for a conference in New York City of the ‘Birthing Partners’ and over 60 other schools in 1906 to find solutions for the violence or the game would be banned. Running with the ball was the primary method of advancing the ball. Kicking the ball was very limited. Among the many rule changes that were installed to make a ‘safer game’ was the Forward Pass. Initially, the penalty was steep for an incomplete pass. The opposing team was awarded the ball for an incompletion. Not many teams used the Forward Pass until a few years later when the incomplete pass rule was changed to the rule used today. Universities began to see a monetary bonanza as the popularity of ‘Modern Day Gladiators’ filled the stadiums. Smaller stadiums were demolished to make way for larger more permanent stadiums on campuses.

My 2018, 2nd CFP took my Feet back to the east coast. By plane, my Feet flew to Philadelphia, PA. A Red Rental Chariot then took my Feet to outside of New Haven, CT for the Yale Bowl. The Yale Bowl was built in 1914. At the TIME of completion, it was the largest stadium in the world with seats for almost 71,000 fans. It was also the first bowl shape stadium in the world. Others, including Michigan Stadium and the Rose Bowl copied its design. The uniqueness of the structure with no concourses underneath adds to the trip into the past. One must enter the stadium through concrete portals similar to ‘Star Trek’, built through the earthen berm. Restrooms and concessions are located on a paved concourse outside of the stadium. The Yale Bowl is honored by its spot on the U.S National Historic Landmark. It ranks #4 on the list for the Oldest College Football Stadiums in the USA.

The RR Chariot under the guidance of a GPS next brought my Feet near Cambridge MA, home of Harvard Stadium. It was built in 1903 as the 1st ‘Concrete Stadium’ in the USA for college football. The original and current design seats about 30,300. During its heydays, Harvard Stadium was expanded to 57,166 to meet the popularity of the game.
Harvard Stadium’s horseshoe design and the columns supporting the roof, takes one’s IMAGINATION back to Greece or Rome with visions of Gladiators. Harvard Stadium is also honored by its spot on the U.S National Historic Landmark. It is considered as the 2nd Oldest College Football Stadium in the USA. While in the Boston area, my Feet sat in Alumni Stadium on the campus of Boston College. My Feet played as a Modern Day Gladiator for Pitt in 1971 in Alumni Stadium. The stadium had been expanded but the old memories were joined by the new memories.

Last stop on the 2018, 2nd CFP called for a return trip back to Philadelphia in the RR Chariot. Ben Franklin greeted my Feet before they entered Franklin Field on the campus of Penn University. It was originally built in 1895 with wooden stands and seats for about 30,000. Wood gave way to concrete and more seats in 1922. Capacity rose to about 50,000. The explosion of College Football caused Franklin Field to add a second tier in 1925 increasing its seats to around 78,000. Demise and TIME has reduced Franklin Field to its current seats of about 53,000. Franklin Field was the first stadium with a scoreboard in 1895 and the 1st stadium to build a second tier in 1925. It currently holds the title as the #1 Oldest College Football Stadium in the USA. The stories of the 2018, 2nd CFP can be found on our homepage or in the Pilgrimage Section on the Homepage.
For a bonus, while on the east coast, a visit of 8 days to Quiptown, Aliquippa, PA was on the itinerary concluding the month long Pilgrimage. Relationships with family, friends and others were connected along with the bonding of ‘Great Food’, and the ‘ Fantastic Energies’ of being back in familiar surroundings. The 2018, 2nd CFP created many Blessings, Gifts and Encounters with Angels for my Feet to share with others. The opportunity to walk among ‘The Spirits’ that created and molded the Modern Game of American Football was met with AWE. Being able to stand in the middle of the 50-yard line at each stadium and use the Power of My IMAGINATION, my Feet stepped back in TIME for a moment. Gooseflesh joined my Feet to add and share the AWE. Instead of seeing empty seats, My IMAGINATION soared back to the beginnings of each stadium as the roar of capacity and overflowing crowds echoed within my Feet.
GRATITUDE
With Blessings, Gifts and Encounters with Angels stuffed in pockets, duffel bags, luggage, and carry-ons, my Feet returned to my Fishbowl in Henderson, NV ‘Safe’ and in ‘Good Health’. God was thanked numerous TIMES during my 2018, 2nd CFP. After settling in, and completing a few days of landscaping chores, the End Game signaled for attention. Most of the paperwork for the End Game was completed before departing for the 2018, 2nd CFP. All that was left was the final touches in order to answer the ‘SILENCE’ of the CCSD.
The CCSD did not respond to my Cease & Desist Letter. As with all previous dealings with the CCSD concerning Scott Baker and the SNVBS on the campus of Basic Academy/HS, this ‘SILENCE’ was a sign of CONSENT to continue the Quest for the Truth of My INSANITY. The only items remaining were: an opening statement to the judge, necessary legal documents for the clerk’s approval, and which court to file.
It took a few days prior to Thanksgiving to compose the opening statement. Monday, Nov. 26, 2018 would be the day to file the documents in the Henderson Justice Courts. The search on the internet for the correct legal briefs found only one document, a cover page for ‘Other Civil Matters’. The UNKNOWN would lead the way. To add to the holidays, friends from Quiptown started to exchanged holiday emails. Some of the stories revolved around the word, ‘GRATITUDE’. The Boys From Quiptown are at TIMES an outlet to share My DREAMS with. A Dream is just a wish, if it is not written down. A Dream is just a wish, if it is not shared with others. Do all Dreams come true? Of course not, for it just a sign to shift our Dreams.
One of my comments during the exchange of the group’s email, ruffled a few Turkey Feathers. This ‘Ruffling’ Inspired the next letter ‘Happy Turkey Day 2018’.
Happy Turkey Day 2018
To all the Turkeys that are reading this, apparently my ‘Chain Letter Comment’ caused a few of your ‘Feathers’ to get ruffled. It was not the intent of my words to ruffle any ‘Feathers’. Nor, were my words intended to implicate that the story passed on by John R through Tim O was a ‘Chain Letter’. Any Turkey, including myself, KNOWS that John’s Story was not a ‘Chain Letter’. His story revolved around the word ‘GRATITUDE’, the Granddaddy of all Virtues. As one reads John’s tale closely, many examples of the Virtue GRATITUDE are shared even until the end. The ‘little girl’ would be GRATEFUL if ‘Fucking Home Depot delivered the drywall’.

The confusion of the ‘Referenced Chain Letter’ was probably influenced by my lack of clarity. It should have stated the ‘FUCKING CHAIN LETTER THAT O SENT TO MY EMAIL ADDRESS ON TUESDAY NIGHT, 11/20/18. For those Turkeys that are reading this, ‘How many of you received the same FUCKING CHAIN LETTER FROM O? The Fucking Chain Letter included the same theme as John’s Story. GRATITUDE led the way from the start to the finish. Unlike John’s Story, the Fucking Chain Letter came with directions.
John’ Story of GRATITUDE came only with Blessings with no strings attached. The Reader was left to their own IMAGINATION of how to proceed with forwarding the Blessings or not? The Fucking Chain Letter also came with Blessings but with a ‘Price’. If the Reader wanted ‘Good Luck’, instructions required the Reader to forward the Fucking Chain Letter to ten other Readers. If the Reader did not adhere to the directions, then a Blessing of ‘Bad Luck’ would be cast on the Reader.

For those of you who believe in the powers of Fucking Chain Letters, please continue to do so. However, in my Universe, it is the Power of Prayers that is Practiced. Prayers that include GRATITUDE. After reading both stories, I was GRATEFUL that my friends included my email address, for their thoughts were shared with my thoughts. Sharing TIME With Others With No Guarantees is a Blessing of itself. John’s Story was neatly filed away for another day. The Fucking Chain Letter was immediately trash and its Blessings were stopped at My ASS & 2 BRAINS..
It was decided to let Prayer take on the ‘Bad Luck’. Exactly, what is ‘Bad Luck’? Are daily problems and obstacles ‘Bad Luck’? When a piece of equipment does not function is that ‘Bad Luck’? When things don’t go your way, is that ‘Bad Luck’? Marcus Aurelius teaches that problems and obstacles are designed to entertain us in order to prevent Boredom from killing us. Many Greats along with Aurelius teach that we should also be GRATEFUL for our problems and obstacles. For they teach us how to focus on the solutions for Growth and not the problem. If you want a problem to get bigger, just keep focusing on the problem.
This word ‘LUCK’ has permeated its presence in our society that has lead others to believe that ‘LUCK’ controls the outcome of Personal Lives, Sporting Events, Elections, Job/Career Opportunities, Personal Relationships, Financial Decisions, etc. If ‘LUCK’ was involved, then why do people invest so much TIME and Effort into their DREAMS, Careers and Lives? Voltaire claimed that there is no such thing as Chance. Other Greats after him claim ‘LUCK is what you make it’. Question, ‘Has any one reading this ever met LUCK’? ‘Can LUCK be brought’?
Recently, I read that only 40% of adults consider themselves as avid readers. I call them IMAGINATION Artists for they paint the images of the words in the brain as they read. If that statement is TRUE, 6 out of 10 of you receiving this email have by now stopped reading. Previous messages have indicated that a few read my entire writings. Other signs indicate that a few look at the length of my words, and turn to other things of interest. Whether your senses continue is your choice and for that, I am extremely GRATEFUL for spending any amount of TIME with your senses.
There are plenty of known benefits for those who are avid readers versus those who spend TIME on their screens and only read short snippets. Studies indicate IMAGINATION Artists have lower dementia and longer LIFE-spans. Before I begin to explain recent developments, a more in depth look of the virtue ‘GRATITUDE’ is warranted.
Gratitude according to other ‘Greats’ that walked this planet before us all agree that GRATITUDE is the KING of all other virtues. Before one can partake regularly with other virtues and values, one must practice GRATITUDE daily. If one does not practice GRATITUDE, all other virtues will fall short.
“Robert Emmons, perhaps the world’s leading scientific expert on gratitude, argues that gratitude has two key components, which he describes in a Greater Good essay, “Why Gratitude Is Good.”
“First,” he writes, “it’s an affirmation of goodness. We affirm that there are good things in the world, gifts and benefits we’ve received.”
In the second part of gratitude, he explains, “we recognize that the sources of this goodness are outside of ourselves. … We acknowledge that other people—or even higher powers, if you’re of a spiritual mindset—gave us many gifts, big and small, to help us achieve the goodness in our lives.”
Emmons and other researchers see the social dimension as being especially important to gratitude. “I see it as a relationship-strengthening emotion,” writes Emmons, “because it requires us to see how we’ve been supported and affirmed by other people.”
Because gratitude encourages us not only to appreciate gifts but to repay them (or pay them forward), the sociologist Georg Simmel called it “the moral memory of mankind.”
For more on the Power of GRATITUDE, visit the link , “Why Gratitude Is Good”.
As Thanksgiving Day, 2018 winds down, may GRATITUDE share your DREAMS of ‘Good Health’ and ‘Good Fortune’ each and every day of your TIME on this planet. Please continue to share your tales and stories of GRATITUDE and other Virtues. If ‘Fucking Chain Letters’ are included, my Prayer of Thanks will be given as the Chain is Broken and Trashed.
If your TIME allows, another short story is attached. It is titled ‘PETITION for TC&DO 11-18’. It is about 3,400 words or roughly 10 minutes of your TIME. It is the End Game after 3 plus years on my Quest for the Truth of My INSANITY. In it, My ASS & 2 BRAINS carry the Banners of West Aliquippa, and Aliquippa as my words venture into a Road Not Taken. Some fine-tuning remains, for the End Game is scheduled for Monday, Nov. 26, 2018. If GRATITUDE stops by for a visit during your voyage as an IMAGINATION Artist, feel free to share GRATITUDE with others in your Words, Actions, Thoughts, and Prayers.

PETITION FOR A TEMPORARY INJUNCTION AGAINST THE CCSD AND THEIR ASSOCIATION WITH SCOTT BAKER AND THE SNVBS ON THE CAMPUS OF BASIC ACADEMY/HS IN HENDERSON, NV.
As the Quest for the Truth of My INSANITY continues, please permit my Feet to extend my GRATITUDE to all that have sent their words, thoughts, and prayers to use as fuel during My Quest. Also, my THANKS go to all that have provided the Inspiration, Guidance, Wisdom, and Stimulation for My Quest, especially My 2 Angels of INSANITY, Angel Compassion and Angel Passion Chaffee. Next is a copy of the statement attached to the ‘Complaint for a Temporary Injunction’.
11/29/18
Temporary Injunction Against Members of the Clark County School District And Their Association With Scott Baker and the Southern Nevada Blue Sox a Private Baseball Organization on the campus of Basic Academy/HS in Henderson, NV.
Your Honor,
My name is George N. Feher. I have been a resident of this great city of Henderson, NV since 1979 with a population of about 18,000 residents. My thanks are extended to you, if your eyes read my words. This request for a Temporary Injunction (TI) has a history of 3+ years. It is also well documented and should not be considered as a trivial matter for members of the Basic Academy/HS zone are being affected. Attached is evidence of the documentation that has been submitted to the court for their consideration in the matters of this case.
This Temporary Injunction is a very complex issue for one of the parties (Scott Baker) plays two roles with the Clark County School District. Role #1 is that he serves as the Varsity Head Baseball Coach at Basic Academy/HS located at 400 Palo Verde Dr., Henderson, NV. Role #2 is that his Southern NV Blue Sox private baseball organization has been granted permission to operate legally with the CCSD on the campus of Basic Academy/HS on the ‘Dime of the Henderson Taxpayer’. Though the Southern NV Blue Sox is considered a legal operation, nowhere in the CCSD regulations and guidelines can be found the rules, governing that it is an Ethical, Moral, and Non-Discriminatory operation according to the standards of the residents and Taxpayers of the Basic Academy/HS zone.
Though this issue only faces a fraction of a percentage of the local school zone, the ‘Rights and DREAMS of Others’ in our community are being affected. My role in this issue also has two sides. My 1st Side is that of a Taxpayer in the zone of Basic Academy/HS. My 2nd Side is that of an Advocate for all those that been affected, currently affected, and could be affected in the future. Those ‘Affected’ had or have no recourse of action since this operation was established on the campus of Basic Academy/HS during the 2010-11 school year.
The ‘Quest for the Truth of My INSANITY’ started in the spring of 2015. My Quest is well documented on my website at playinyourdreams.com in the ‘Win a State Title’, ‘Dream Newsletter’, and/or the ‘Inspiration’ section on the homepage. Plus, other versions can be found on my Facebook page, Nick Feher ‘TAKE 5’ Foundation. As previously stated, this is a complex issue. As a Henderson Taxpayer and an Advocate, Role #1 of Scott Baker with the Clark County School District should be excluded and not to be considered for my requested TI . That contract is between Scott Baker, an employee, with the CCSD and Basic Academy/HS.
It is Role #2 of Scott Baker and his Southern NV Blue Sox private baseball operation and his association with the CCSD that is to be included in my requested TI. During my 3 plus year Quest, others in our community shared their views concerning the operations of the SNVBS and Scott Baker on the campus of Basic Academy/HS. All perceived this operation of Scott Baker and the SNVBS as being Unethical, Immoral, Discriminatory and possibly Fraudulent. My Quest during the past three plus years took my words to many outlets including the CCSD, Basic Academy/HS, the CCEA, the ACLU, local media outlets, City of Henderson, Officials in the Nevada State government including State Senators, and State Representatives.
Not one person or outlet would answer my questions after being presented with the same facts and now with more facts that are being presented to this court. Question #1, ‘Is the Scott Baker SNVBS operation and the association with the CCSD an Ethical, Moral, Non-Discriminatory Operation according to the standards of the residents and Taxpayers of the Basic Academy/HS zone, or not’? Question #2, Would you and your family pay between $21,000-$30,000 for four years for your son to play baseball at the Basic Academy/HS, or not’? Next is a copy of the Letter To Cease and Desist that was sent via USPS with documentation and an email that was also sent to all parties in question.
NOTICE TO CEASE AND DESIST
FROM
George N. Feher
332 Hull St.
Henderson, NV. 89015-5633
Date: 8/15/18
NOTE: This is a replica of a certified/registered letter and email that was delivered to the Offices of the CCSD at 5100 W. Sahara Ave., Las Vegas NV 89146. USPS records indicate that the front desk accepted the package with a signature. USPS records also show that a replica certified/registered letter was delivered to Principal Gerald Bustamante at Basic Academy/HS at 400 Palo Verde Dr., Henderson, NV. 89015. It was signed by the individual.
Re: Notice to Cease and Desist the operations of Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy/HS, located at 400 Palo Verde Dr., Henderson, NV. 89015
Attention: CCSD Trustees; Deanna L. Wright, Carolyn Edwards, Lola Brooks, Linda P. Cavazos, Kevin L. Child, Chris Garvey, Dr. Linda E. Young, Superintendent Jesus Jara and Principal Bustamante of Basic Academy/HS
This letter is served upon, due to the unwanted and perceived discriminatory, immoral, unethical operations of Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy/HS, located at 400 Palo Verde Dr., Henderson, NV. 89015.
I write to you as a Taxpayer in the Basic Academy/HS zone and as an Advocate for all past, current, and future potential high school baseball players and their families, who have either been victimized, or will be victimized by this operation while they attended, or are currently, and/or planning to attend Basic Academy/HS.
This operation was originally brought to the attention of each CCSD School Board member, and former Superintendent Pat Skorkowsky plus former Principal Dave Bechtel by letters and emails during the months of July, October and November of 2015. Copies and acknowledgement of these letters and emails remain in my possession.
More letters and emails to the CCSD and other public entities followed throughout 2016, 2017 and most recently in 2018 to the current Principal Gerald Bustamante at Basic Academy/HS all expressing the same theme. It was for the removal of Scott Baker and the Southern Nevada Blue Sox an ‘Unwanted Operation’ from the campus of Basic Academy/HS.
Principal Dave Bechtel along with a small group of others originally initiated the operations of Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy/HS during the 2010-11 school year, against the disagreement of many others in the community. Without surveying the staff, school population and families at the time along with the taxpayers in the Basic Academy/HS zone, an autocratic decision was enforced without feedback from the community. These practices remain in effect to this day.
Official Public Records will prove that the sport of baseball is conducted under a set of guidelines that are not offered, and/or practiced by the other sports at Basic Academy/HS. This ‘autocratic decision’ was designed to coerce players and families to pay extra fees to Scott Baker and the Southern Nevada Blue Sox to qualify for the opportunity to try out and secure a roster spot on the Basic Academy/HS Varsity and JV Baseball Teams. These extra fees are estimated to be in the range of $5,000 to over $7,000 a year or a total of $20,000 to $30,000 over a 4-year period. This total sum along with the Millennium Scholarship is equivalent or exceeds the costs for, a four-year college degree from CSN or Nevada State College.
It is also a known fact according to members in the Henderson community that players and families from the lower socio-economic backgrounds, including members of the local Boys & Girls Club were and are prevented from earning a roster spot on the JV and Varsity Baseball Teams. These same community members and others view this travesty as ‘Discrimination’.
Then there is another group of players and families who refused to contribute to this unwanted, perceived immoral and unethical operations of Scott Baker and the Southern Nevada Blue Sox. Their willing actions of ‘Common Sense’ prevented their sons from earning a roster spot on the JV and Varsity Baseball Teams at Basic Academy/HS. Where is it stated in the CCSD Regulations that only a select group of players and families must pay exorbitant fees to play a high school sport? Since Principal Gerald Bustamante has refused to remove this ‘unwanted operation’, seeking a legal remedy will be my next option.
If you do not cease the aforementioned Operations of Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy/HS, located at 400 Palo Verde Dr., Henderson, NV. 89015, a lawsuit will be commenced against you.
If the ‘Unwanted Operation’ continues, I will seek a temporary Cease & Desist Order in the Henderson Courts against you and any accomplices in this matter. A judge will be provided the facts in order to rule on the merits of the TC&DO. If possible, I will also seek monetary damages to be proved at trial. Principal Bustamante, a former minority student, who played ‘Free Baseball’ with reasonable fees at Basic High School, parlayed his academic and baseball skills into a college baseball scholarship. Should not all current and future potential baseball players of Basic Academy/HS be provided the same opportunity?
Plus, a possible trial would open the door to many questions that will have to be answered by you, including: “Would you and your family personally pay $21,000 to $30,000 over a 4-year period for your son to play baseball at Basic Academy/HS”? Another would be, “Why is the CCSD willing to spend taxpayers’ money to defend an unwanted, perceived immoral, unethical and discriminatory operation on the campus of Basic Academy/HS”?
Hopefully this recourse is not necessary. As an Advocate, I have the very best interests of the players and families of the Henderson Basic Academy/HS Baseball Community to protect and will vigorously do so. You will not receive another warning letter. If you do not confirm in writing to me by the 25th day of August, 2018, that you will cease violating our Agreement, a lawsuit will be commenced.
George N. Feher
END of LETTER
Exhibit D contains excerpts from NOTIFICATIONS TO CCSD ABOUT FEES COLLECTED BY SCOTT BAKER & THE SOUTHERN NEVADA BLUE SOX from 4/9/15 thru 8/15/18
Other attached documents will show a pattern that this private baseball operation by Scott Baker and the SNVBS and their association with the CCSD is an Unethical, Immoral, and Discriminatory operation that is impacting the DREAMS and Rights of our local youth who want to play ‘Reasonable Free Baseball’ at our local Basic Academy/HS. The possible Fraudulent charges of Scott Baker and the SNVBS with the CCSD will have to be determined in a different courtroom. However, the document attached titled Exhibit C, which includes, ‘Clark County School District, District Facility Use Permit, dated Oct 29, 2015’, Public Records of the CCSD, has been submitted for evidence to this court. All outside agencies wanting to rent CCSD facilities must truthfully complete this document in order for the CCSD to determine if a rental fee of the CCSD facility is warranted or not.
On the line highlighted, ‘Cost to Participants’ a zero with a slash thru it, indicates that Scott Baker and the SNVBS did not charge for his services while operating on the campus of Basic Academy/HS with the Henderson Taxpayers’ Dollars. However, in the evidence attached to Exhibit A, (‘Stories of Paying Fees to Scott Baker & the Southern Nevada Blue Sox’) there are numerous claims that he does. If these claims are true, then Scott Baker falsified these documents to gain a financial advantage with the CCSD on Henderson Taxpayers’ money.
According to Exhibit C, the attached document titled, ‘Clark County School District Facility Usage Rates’ marked July 14, 2014 and the document marked, Rev. 01/02/18, a fee to all Profit and Non-Profit groups must be paid to the CCSD if the groups renting a CCSD facility charge a fee to their participants. Evidence shows on pages 30 & 31 in Exhibit A, that Scott Baker and the SNVBS had his non-profit status revoked by the State of Nevada. If that is true, then Scott Baker and the SNVBS should be charged the rates of a Profit Organization by the CCSD.
If your Honor merits that these documents should be included in my request for a TC&DO, then please add them to the other evidence. As my words continue, permit them to explain more of my background. I am originally from West Aliquippa, Pa, a section of Aliquippa, Pa, a small former steel town, 20 miles north of Pittsburgh, Pa.
After earning a ‘Grant-In-Aid Scholarship’ to play football while attending the University of Pittsburgh and following my Education Degree from Pitt, my Dreams said to go West. My arrival to the Las Vegas Valley was in June of 1975. After serving one year plus as a substitute teacher in the CCSD, my Dream of being a full-time teacher matured in the fall of 1976 as a Physical Education teacher at Matt Kelly 6th Grade Center.
Another Dream, led to the opening of Garrett Junior HS in Boulder City, NV as the chairperson of the Physical Education Department in 1979, which prompted the purchase of a house in Henderson, NV. This was after a year of being chosen as one of three candidates to conduct a Pilot Elementary School Physical Education Program in the CCSD at Cyril Wengert Elementary School. At that time, elementary schools only had very limited or no Physical Education classes in the CCSD. The 3 programs proved to be so successful, that Elementary Physical Education was incorporated permanently into the CCSD Elementary Curriculum in the 1979-80 school year.
During the same time period, a Master’s Degree in Physical Education was earned from UNLV. Overall, my CCSD career expanded to include stops to open the New Las Vegas High School on Sahara Ave, Las Vegas, NV with one final stay at Chaparral High School in Las Vegas, NV. My tenure with the CCSD lasted for almost 34 years. Additional coaching duties included, Girls Basketball at Garrett JHS, JV and Varsity Men’s Basketball at Basic High School, Varsity Football at Basic HS and Boulder City HS, plus Freshman Football and JV Softball at the New Las Vegas HS.
My residence in Henderson, NV, eventually led to a marriage and a family of three children. When our children became of eligible age, my coaching and volunteering in the Henderson Community switched to Youth Sports. These Youth Sports included stints with the Henderson United Youth Soccer league, the City of Henderson Youth Basketball, the Henderson Girls Softball Association, the Henderson Little League, as both a coach and a member of the HLL Board, the Henderson Fall Baseball Association, a Henderson Club Basketball Team, the Boys & Girls Club Youth Basketball League and the Timet Wolves Bronze American Legion Baseball Team.
It was during all these years of dealing with the youth in and out of our Henderson Community that lessons of Ethical, Moral, Non-Discriminatory Actions and Behaviors were shared. Recently, these lessons have shifted to include; help Promote and Share the DREAMS of others, while showing others ‘How to Protect Their Dreams’. For DREAMS left unprotected will be stomped on or stolen from Destroyers of Dreams. This is what is occurring in our local community of Henderson, NV. A small group of Destroyers of Dreams at Basic Academy/HS is preventing the ‘Selected Youth’ of our community from PLAYIN THEIR DREAMS of ‘Free Reasonable Baseball’.
These ‘Selected Youth’ have been targeted for their economic status and others whose families refuse to pay the ‘Exorbitant Fees’ that are associated to play high school baseball at Basic Academy/HS. Questions about these ‘Exorbitant Fees’ were directed in writing to Principal Bustamante at Basic Academy/HS. These questions and other questions to Principal Bustamante remain unanswered. According to a newspaper story in the Las Vegas Review Journal that is included in the evidence Exhibit A, Principal Gerald Bustamante is a graduate of Basic High School. As a minority student, he parlayed his learned ‘Baseball Skills’ at Basic HS to earn a partial scholarship to play college baseball while earning his college degree.
During his tenure as a student/baseball player at Basic HS, while playing under Head Baseball Coach Gary Chaires, student Gerald Bustamante and his family did not have to pay ‘Exorbitant Fees’ to play baseball at Basic HS. Coach Gary Chaires has been honored for his achievements by having the Basic Academy/HS Baseball Stadium named after him.
To add injury to insult, current head baseball Scott Baker and his family also played ‘Free Reasonable Baseball’ at Basic HS under the tenure of Coach Gary Chaires. During their time at Basic HS, Gerald Bustamante and Scott Baker were part of a Baseball Program that was deemed, Ethical, Moral, and Non-Discriminatory by members and Taxpayers of the Basic HS zone.
Attached to Exhibit B, are Public Documents that were requested by me from the NIAA office in Carson City, NV. These documents list the official NIAA Basic Academy/HS Varsity and JV Baseball Rosters from the school years 2010-11 to 2017-18, that were submitted by Basic Academy/HS. Also in Exhibit B, are Public Documents that were printed from the Southern NV Blue Sox website. These two documents were used to cross-reference the baseball players that played on the Basic Academy/HS Varsity and JV Baseball teams that also paid a fee to play on the private baseball organization Southern NV Blue Sox and Scott Baker.

If the first baseball season of the 2010-11 school year is removed from the study, the numbers indicate a pattern of Unethical, Immoral, and Discriminatory actions and behaviors that were conducted by Scott Baker and the SNVBS with the association and approval of the CCSD. There were a total of 214 players listed on the NIAA official rosters. When these players’ names were cross-referenced against the names on the rosters found on the SNVBS website, 205 players were listed on both rosters. Only 9 players from seven different school years could not be cross-referenced on both rosters. The rosters confirm that almost 96% of all players paid a fee to Scott Baker and the SNVBS in order to compete for a roster spot on the Basic Academy/HS Varsity and JV Baseball teams from the school year 2011-12 to 2017-18.
In closing, again accept my GRATITUDE for reading and considering my case for a Temporary Injunction against the CCSD and their association with Scott Baker and the SNVBS. My End Game has led to the chambers of your court. Your ‘Legal Decision’ will end the Quest for the Truth of My INSANITY. The complexities of the case are many including, ‘Can an operation declared legal by the CCSD, be declared Unethical, Immoral and Discriminatory by the court of law as it pertains to the standards of the residents and Taxpayers of the Basic Academy/HS zone’? If ‘YES’ is the choice of the courts, then grant my request for a Temporary Injunction against the CCSD and its members, CCSD Trustees; Deanna L. Wright, Carolyn Edwards, Lola Brooks, Linda P. Cavazos, Kevin L. Child, Chris Garvey, Dr. Linda E. Young, Superintendent Jesus Jara, and Principal Bustamante with their association with the operations of Scott Baker and the SNVBS on the campus of Basic Academy/HS.
If my future services can add to your decision making process, I stand ready to serve and to answer all questions truthfully and to the best of my knowledge. Next is a copy of short messages that were sent to me on my Facebook page. Vera and I have had a relationship during our time shared at the Ye Olde Henderson Baseball Celebrations that were held for a few years at the Black Mt. Aquatic Complex, compliments of local businesses plus others and the Nick Feher ‘TAKE 5’ Foundation.

ON MONDAY, 11/26/18 MY FEET TRAVELED INTO THE UNKNOWN WITH LIMITED PAPERWORK TO FILE AN INJUNCTION AT THE HENDERSON COURTS
Some experience did sit with my Feet, for in 2007, my Feet had to fill-out legal proceedings for a TRO against other individuals for my minor son, Nick. After glancing at my paperwork, the clerk politely asked if my Feet had seen a lawyer. I replied ‘No’. He said that according to the laws, he could not answer any legal questions. When my verse was completed, he wrote down the name of a Legal Aid Office. I then returned to my Fishbowl, and a telephone call was left on a voicemail. The recording said a rep would call back in 24 hours. Next stop, later that afternoon was an email to an Attorney Referral Service. For a reasonable fee of $45, one could schedule a 30-minute consultation to discuss your case. Phone messages were left on Monday and Tuesday along with an email to the Referred Attorney.
With no monetary damages being sought, the only need for an attorney was for the filings of the legal documents. The rest of Monday, most of Tuesday and some on Wednesday was spent on research for filing legal documents. The research proved profitable for as of this writing, no return calls or messages came from the so-called help. With examples provided by the Civil Court Help Center located downtown Las Vegas in the regional court building, God led the way. If one was to ask for my Feet to retrace the steps to find examples needed on their website, my Feet would only stand in GRATITUDE.
On Thursday afternoon, 11/29/18, as the rains danced on my vehicle a nearby parking spot was found next to the Henderson Courts. My Feet left tracks in the puddles as the rains continued. Once inside, my Feet again sat at the clerk’s window with a set of court documents. The clerk took a quick review and then called for a supervisor. The supervisor after a longer review said that the Henderson Justice Courts does not deal with these types of Complaints. When my Feet asked, which court does, she replied the District Court in downtown Las Vegas. After my documents were handed back, one final question remained for the first clerk. “Would these documents pass the ‘Smell Test’ for the clerk’s office in district court”? Her SMILE said, we cannot give any legal advice.
The lateness of the day and the wet weather said to return to my Fishbowl for Friday would be the day. First stop at 8:30am would be a regularly scheduled 2-hour massage followed by a steam. Then a trip to District Court would be next. As a bonus, if any questions needed answering, the Civil Court Help Services were located on the 1st floor. As my long TIME Massage Therapist, and supporter of the Nick Feher ‘TAKE 5’ Foundation was concluding business with my Feet, talk and questions were exchanged. Kevin Hamel of Curatio Massage was thanked for opening up my Chakras. My Feet explained that a steam was next followed by a trip to District Court. When reminded of My Quest and today’s purpose, Kevin said, I cannot believe that your Feet are stilling dealing with that issue.
My Feet then said the End Game is near and a Judge will have the final say. He asked if there was any monetary damages being sought. My Feet said ‘No’. It is about GRATITUDE. Then, my Feet said, with my Chakras wide opened, may the ‘Powers & Energies’ of the Universe open the door at the District Court for my Complaint for a Temporary Injunction. With a SMILE, he declared, ‘May the Force Be With You’. My Feet thanked him and off to a steam they went. During the steam, many thoughts buzzed through my IMAGINATION, including all of the ‘Fantastic & Great Energies’ that have assisted my Feet during the Quest for the Truth of My INSANITY. As these ‘Fantastic & Great Energies’ multiplied along with all the Blessings, Gifts and Encounters with Angels obtained during my College Football Pilgrimages, TIME and Forces said that my Feet were ready for the End Game.
The first stop was the Civil Court Help Center on the 1st floor. Since it was their example that was used as the format, their help would be sought. A quick scan found my papers to be acceptable to be filed as a legal document. However, additional paperwork was needed as in the Summons for the defendants to appear in Court. Once filled out for each defendant, a quick review declared that all was in order. My THANKS was extended to the staff and was expressed on a survey. My Feet rode the escalator up to the 3rd floor to the District Court Clerk’s Office. As my Feet waited to be called, the Quest for the Truth of My INSANITY was entering the End Game. The End Game was viewed as only a RESULT. For in the Game of LIFE, there are ‘No Winners’ and ‘No Losers’, but only RESULTS. If the Documents were not legally correct, then a correction would have to made.
If the Documents were legally correct, then a Case Number would be the RESULT. Regardless of the outcome of the Case, my Feet would stand KNOWING that my Feet did their ‘Very Best’ to show GRATITUDE for permitting my Feet to Share and Promote the DREAMS of Others while Encouraging Others to Protect Their DREAMS. Doing One’s ‘Very Best’ in the Game of LIFE is All One Should Expect From Oneself. Nothing More and Nothing Less. Finally, my Feet arrived at the Clerk’s counter. After a few minor adjustments, the Clerk approved the documents and assigned them a Case No. after a small fee was paid. Next is the example of part of the filings.

Case No.: A-18-785265-CDept. No.: XV |
COMPLAINT FOR A TEMPORARY INJUNCTION
- Plaintiff, George N. Feher, in proper person, complains against Defendants CCSD Trustees; Deanna L. Wright, Carolyn Edwards, Lola Brooks, Linda P. Cavazos, Kevin L. Child, Chris Garvey, Dr. Linda E. Young, CCSD Superintendent Jesus Jara and Principal Bustamante of Basic Academy/HS in the matter of their continuing association with Scott Baker and the Southern Nevada Blue Sox, a private baseball organization that currently operates on the campus of Basic Academy/HS at 400 Palo Verde Dr., Henderson, NV 89015.
I FACTS
2. Principal Dave Bechtel along with a small group of others originally initiated the operations of Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy/HS during the 2010-11 school year, against the disagreement of many others in the community. Without surveying the staff, school population and families at the time, along with the taxpayers in the Basic Academy/HS zone, an autocratic decision was enforced without feedback from the community. These practices remain in effect to this day.
3. Taxpayers, residents and members of the Basic Academy/HS zone view this private baseball operation by Scott Baker and the SNVBS and their association with the CCSD as an Unethical, Immoral, and Discriminatory operation that is impacting the DREAMS and Rights of our local youth who want to play ‘Reasonable Free Baseball’ at our local Basic Academy/HS.
4. Numerous past attempts through letters and emails to the ‘Defendants’ for answers to questions regarding this perceived Unethical, Immoral, Discriminatory, and possible Fraudulent private baseball organization of Scott Baker and the Southern Nevada Blue Sox that currently operates on the campus of Basic Academy/HS with the assistance of Taxpayers’ money remain unanswered.
5. The Plaintiff sent a Cease and Desist Letter dated 8/15/18 via certified/registered USPS with a back-up email Cease and Desist Letter to the Defendants requesting that the Defendants end their association with Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy in Henderson, NV.
6. The Defendants did not cease the aforementioned Operations of Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy/HS, located at 400 Palo Verde Dr., Henderson, NV. 89015.
II CLAIMS FOR RELIEF
7. After three plus years as an ‘Advocate’, the Plaintiff has discovered that there is no other recourse of action to settle the association of the Defendants with Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy/HS.
8. ‘Selected Youth’ of the Basic Academy/HS have been targeted for their economic status and others whose families refuse to pay the ‘Exorbitant Fees’ that are associated to play high school baseball at Basic Academy/HS have no legal recourse within the regulations of the CCSD.
III PRAYER FOR RELIEF
WHEREFORE, Plaintiff prays for the following relief:
9. A Temporary Injunction that ceases the association of the Defendants with Scott Baker and the Southern Nevada Blue Sox on the campus of Basic Academy/HS in Henderson, NV.

When the Clerk completed the filings, the Summons, the first page of the Complaint with the Case #, Court #, and a receipt for the transaction was given for departure. THANKS were extended to the Clerk verbally, while my thoughts gave THANKS to God. A final stop at the Help Center was next to clarify the deliveries of the Court Summons. Options were explained, and the lateness of the day convinced my Fading Feet to return to the Fishbowl. Monday, 12/3/18 would be set for another trip to the Henderson Courts to visit the Henderson Constable’s Office. The weekend was spent with College Football Conference Title Games along with landscaping chores and a Float With Alice.
The first stop Monday morning at the Constable’s Office signaled for my Feet to head back to the Fishbowl to retrieve the checkbook for credit cards were not accepted. The 2nd stop RESULTED in payment for the Court Summons to be delivered to all 9 defendants. After the transaction was finished, one of the Clerks said that she had a story for my Feet. Her eyes had scanned the first sheet of the Complaint, which was now considered a ‘Public Document’. She said that a neighbor of hers had a son that was zoned for Basic Academy/HS. He is a pretty good baseball player. But, because of the ‘Exorbitant Fees’ associated with playing baseball at Basic Academy/HS, a zone variance for Las Vegas HS was requested and approved. As her Superior listened in, and after our talk ended, she added her words.
She said that having to pay between $20,000 to $30,000 over 4 years to play baseball at a public high school is just not right. At a private school, that is another story. She agreed that this practice should be halted for ‘Poor Children’ deserve the right to play or at least be given a ‘Fair Opportunity’ to try out and earn a roster spot. As her eyes twinkled in the lights, she THANKED my Feet for the Quest for the Truth of My INSANITY. My eyes moistened as her words of GRATITUDE hit her target of My Soul. As my Feet walked away, my THANKS were exchanged. Later in the afternoon, a Deputy from the Constable’s office made a surprise call on my cellphone for an update. He explained that it was a ‘Courtesy Call’.
Our conversation was extended and he confessed that he was a former high school baseball player and graduate from Liberty HS. He explained that the only reasonable fees that his parents paid to play baseball at Liberty HS was a Season Fundraiser. There were no monthly dues. When told that the fees extended to $20,000 to $30,00 over four years, he paused for a moment and said, that is a lot of money. He finished by saying that ‘Poor Kids’ should have an equal opportunity to try-out and compete for a roster spot on the baseball team at a reasonable cost. He vowed to do his ‘Very Best’ to deliver the Court Summons to the defendants for they should be held accountable in the Court of Law for their actions.
My Feet extended its GRATITUDE back to the Deputy. His offering of doing his ‘Very Best’ was received as a Blessing and a Gift for my Feet and for all of the Feet of the Ye-Olde Henderson, NV Community, and other Feet from beyond that have walked with my Feet during the Quest for the Truth of My INSANITY.
